HOUSE RULES
The Licensee and/or the Occupant shall comply with the following House Rules and all conditions rules and regulations from time to time prescribed by the Licensor (the “House Rules”) for the management and control of the Property and of the building and for the use or operation of the common parts of the building.
Keys
The Licensor shall issue to the Licensee key card(s) for the access of the Property, and if the Licensee and/or the Occupant loses the key card(s), the Licensor shall issue fresh key card(s) to the Licensee upon condition that the Licensee shall pay such replacement cost as required by the Licensor from time to time for the issue of the fresh key card(s). The Licensee shall ensure that all key card(s) are returned to the Licensor on determination of this Agreement.
Pets
The Licensee and/or the Occupant shall not keep any dogs cats or other pets in the Property.
Telephone line, broadband internet and pay television
The Licensee and/or the Occupant shall not alter the existing plans in relation to telephone line, broadband internet and pay television programs provided by the Licensor nor subscribe any extra and/or optional services without the prior written approval from the Licensor and if approved, such subscription and all related and additional costs and/or expenses shall be of the Licensee’s own account. For the avoidance of doubt, the Licence Fee shall in no event be deducted as a result of any suspension or termination of such plans or services or if the Licensee and/or the Occupant does not use any of such plans or services.
Maid Service
Maid service will be provided by the Licensor daily (except Sundays and public holidays), for cleaning and changing of linen once per week and towels three times per week but not on Sundays and Public Holidays. The Licensor reserves the right to alter the frequency of maid service and/or cleaning and/or changing of linen and towels from time to time and to such extent as the Licensor shall in its discretion deem appropriate or necessary.
Prohibited Activities
(a) The Licensee and/or the Occupant shall not use the Property or any part thereof for any illegal or immoral purpose.
(b) No commercial activity of any sort may be conducted at the Property except with the prior written consent of the Licensor, including but not limited to any form of advertising, soliciting or selling of goods or services, distribution of flyers, party activities with crowds of people gathering, etc. at the Property.
(c) The following activities are prohibited at the Property:
(i) to keep or store or cause or permit or suffer to be kept or stored any arms, ammunition, unlawful goods, gun powder, saltpetre, kerosene or other explosive or combustible substance on or in any part of the Property;
(ii) to do or cause or permit or suffer to be done anything in or upon the Property or any part thereof which may at any time be or become a nuisance annoyance damage or disturbance to the Licensor or the licensees or occupiers of the neighbouring premises or in anywise against the laws or regulations of Hong Kong; or
(iii) to do or cause or permit or suffer to be done any act deed matter or thing whatsoever in contravention of the covenants terms or conditions of the Government Lease under which the Property is held from the Government or of the relevant Deed of Mutual Covenant and/or Management Agreement of the building (if any).
No Obstruction
The Licensee and/or the Occupant shall not put or place any dust-bins, garbage-cans, furniture, chattels, packing cases, boxes, goods or any other things in the staircases, landings or other common passages in the building.
Maximum Capacity Policy
The Licensor has a “capacity policy” as to how many people can be accommodated in each unit (based on size and layout). Each additional guest staying overnight at the Property is required to complete a “Extra Resident Arrival Form” at our management office upon check-in. and is subject to a charge whether or not bedding is required.
Registration with Management Office
Any personnel working in the Property for the Licensee and/or the Occupant, such as a babysitter or housemaid, must be registered at the Licensor’s management office and is required to provide a copy of his/her identification card for record purposes.
Maintenance and repair
(a) The Licensee and/or the Occupant shall ensure that the Property is clean and empty of rubbish daily and that all rubbish is disposed of and placed in the rubbish bin supplied or location designated by the Licensor for that purpose.
(b) The Licensee and/or the Occupant shall constantly maintain and keep the whole of the interior of the Property and every part thereof in good clean and proper repair and condition (fair wear and tear excepted) including, but not limited to, all doors, windows, skylights, light bulbs, locks, hinges, bolts, ceilings, floors, water pipes, water closets, water taps, water heaters, electrical installations and wirings, the Licensor’s Provisions and all the Licensor's fixtures and fittings therein.
(c) The Licensee shall carry out any redecorations and make good any damage to decorations or fixtures, or replace with articles of a similar kind and value any items broken or damaged by the Licensee and/or the Occupant as requested by the Licensor.
(d) In the event of any of the drains of the building becoming choked or stopped up owing to careless use by the Licensee and/or the Occupant to pay the cost incurred by the Licensor in cleansing and clearing the said drains from obstruction.
Interior and Exterior of the Property
The Licensee and/or the Occupant shall not:
(a) erect, remove or alter any existing fittings and fixtures partitioning or other facilities or installation of whatever nature provided by the Licensor in the Property or any part thereof nor to install any additional fittings or fixtures;
(b) make or permit to be made any structural alterations in or additions to the Property or to the electrical wirings installations or other Licensor's fixtures and fittings nor to cut maim or injure or suffer to be cut maimed or injured any doors windows walls beams structural members or other fabric thereof; and
(c) exhibit or display within or on the exterior of the Property any writing sign poster signage flag or other device whether illuminated or not which may be visible from outside the Property.
Licensor’s Rights
(a) The Licensee and/or the Occupant shall permit the Licensor and all persons authorized by it to have access to the Property:
(i) for provision of maid service to the Property or carrying out of any maintenance works for which the Licensor is responsible;
(ii) at a reasonable time to view the condition thereof and to give or leave notice in writing upon the Property for the Licensee of all defects and wants of repair there found for which the Licensee is responsible hereunder and the Licensee shall within seven (7) days after every such notice well and sufficiently repair and make good such defects and wants of repair whereof notice shall have been so given or left;
(iii) to execute repairs, if any defects or wants of repair shall be found and if the Licensor shall give or leave a notice in writing at the Property requiring the Licensee to amend the same and if the Licensee shall not within seven (7) days after the service of such notice proceed diligently with the execution of such repairs and the costs thereof (the amount thereof in case of difference to be determined by the Licensor's agent) shall be a debt due from the Licensee to the Licensor and be forthwith recoverable by action; and
(iv) at all reasonable times to view the Property or any part thereof upon prior notice from the Licensor during the period of one (1) month immediately preceding the determination of the Licence Period.
(b) The Licensee shall permit the Licensor to use and maintain existing pipes and conduits in and through the Property (if any). The Licensor or its agent shall have the right to access to the Property at all times to examine the same.
(c) The Licensor reserves the right to name or re-name the building with any such name or style as in its sole discretion may determine and at any time and from time to time to change alter substitute or abandon any such name without the same constituting any actual or constructive eviction of the Licensee and without incurring any liability to the Licensee therefor.
If at any time any provision of these House Rules is or becomes illegal, invalid or unenforceable in any respect, the remaining provisions of these House Rules shall in no way be affected or impaired as a result thereof.
